If your dispute ends up in Court

In today’s climate, an increasing number of disputes are escalating to litigation. Going to court is not only costly but can also be a stressful and intimidating experience. 

 

If you are served with legal proceedings, it is important you seek immediate legal advice. If you do not file a defence within 28 days, default judgment may be entered against you without any further notice to you.

1.     Irregularities

Consider whether there are any irregularities in the claim and statement of claim and, if so, you may apply to have the claim set aside or the offending pleadings struck out.

 

2.     Defend the proceedings

Once we hear your version of events, we can provide legal advice about your grounds of defence to legal proceedings including any set-off arguments. If you also have a cause of action against the plaintiff, we can assist in pleading your counterclaim.

 

3.     Negotiate a resolution to the dispute
